This Notice describes how medical information about you may be used and disclosed and how you can obtain access to it. Please review it carefully. It applies to Davis Chiropractic’s protected health information when the practice is subject to the HIPAA Privacy Rule and to additional protections required by Texas law.
You may request a copy of your medical record and other information in a designated record set, in paper or electronic form, subject to legal exceptions. We generally respond within 30 days and may charge a reasonable, cost-based fee where permitted.
You may ask us to correct information you believe is incorrect or incomplete. We may deny a request for a lawful reason and will explain the denial in writing.
You may request confidential communications by alternative means or at alternative locations, and request restrictions on certain uses or disclosures. We are not required to agree to every restriction, but when you pay in full out of pocket for a service and request that we not disclose information about that service to a health plan for payment or health care operations, we will honor that request unless disclosure is required by law.
You may request an accounting of certain disclosures, a paper copy of this Notice, and a copy of this Notice electronically. You may choose someone with legal authority to act for you. You may file a complaint without retaliation.
Treatment: We may use and share information with other health care professionals involved in your care, such as a physician to whom we refer you.
Payment: We may use and disclose information to bill for services or support payment-related activities, as permitted by law. Although Davis Chiropractic generally operates on a self-pay basis and may provide superbills, this does not eliminate privacy obligations.
Health care operations: We may use and disclose information to manage the practice, improve quality, conduct compliance activities, and support operations as permitted by law.
Other uses permitted or required by law may include public health and safety, reporting abuse or neglect, health oversight, judicial or administrative proceedings, law enforcement in legally specified circumstances, workers’ compensation, organ donation, medical examiners, and compliance with other legal requirements. Applicable Texas law may impose additional limits.
We generally must obtain your written authorization for uses or disclosures not otherwise permitted or required by law, including most uses of psychotherapy notes (if any), most marketing uses, and sales of protected health information. You may revoke an authorization in writing, except to the extent we already acted on it.
We will not use or disclose protected health information for a purpose prohibited by applicable law. Special federal protections may apply to certain substance use disorder treatment records under 42 CFR Part 2, including restrictions on use in proceedings against a patient; any applicable Part 2 records will be handled under those requirements.
We are required to maintain the privacy and security of protected health information as applicable, provide this Notice, follow the terms of the current Notice, and notify affected individuals following a breach of unsecured protected health information when required by law. We may change this Notice and make the revised version available on our website and in our office.
